These Terms & Conditions ("Terms") govern your access to and use of Headcovers.com and any related websites (the "Sites"), and any purchase you make from Headcovers Unlimited, Inc. ("Headcovers," "we," "us," or "our"). Please read them carefully.
By accessing our Sites or placing an order, you agree to these Terms. If you do not agree, please do not use our Sites or place an order.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate.
Your Account
If you create an account, you are responsible for maintaining the confidentiality of your login information and for all activity under your account. Please notify us promptly of any unauthorized use.
Products, Descriptions, and Availability
We work to describe our products as accurately as possible, including colors, fibers, sizing, and features. Even so, actual products may vary, and screen settings can affect how colors appear. Product availability may change without notice, and we may limit quantities, discontinue products, or correct product information at any time.
Pricing and Order Acceptance
All prices are listed in U.S. dollars. We make every effort to display accurate pricing, but errors can occur. If we discover a pricing or product error after you place an order, we may correct the error and contact you, or cancel the affected order and issue a refund. Placing an order is an offer to buy, and we may accept, decline, or limit orders in cases involving suspected fraud, pricing or product errors, inventory limitations, or other legitimate business reasons.
Payment
Accepted payment methods, payment verification, wire transfers, chargebacks, currency, and gift certificate and store credit terms are described in our Shipping & Policies page, which is incorporated into these Terms. All card payments are subject to verification and approval, and we reserve the right to decline, cancel, or limit payment methods for any order or customer based on our internal verification standards.
Shipping, Returns, and Cancellations
Shipping timeframes, fulfillment, delivery issues, and cancellation terms are described in our Shipping & Policies page. Returns, exchanges, and refunds are described in our Return & Refund Policy. Both pages are incorporated into these Terms.
Special-Order and Custom Items
Many wigs, hairpieces, and certain other products are special-order items that we obtain from third-party manufacturers after you place your order. Because these items are ordered specifically for you, they may not be eligible for cancellation once your order has been submitted to the manufacturer, and they may be subject to separate return, exchange, and restocking terms. Any such terms are described in our Return & Refund Policy. If you would like to know whether an item is special-order, please ask us before you order.
Consultations and Recommendations
We are glad to offer consultations, color matching, and product recommendations. These services are provided to help you choose products you will be happy with. They reflect our experience with our products and are not a guarantee of any particular result. Recommendations, color matching, and styling suggestions are based on the information you provide and our professional judgment. We do not guarantee satisfaction with any recommendation, and we are not responsible for differences in personal preference, appearance, or expectations.
No Medical Advice
Headcovers is a retailer. We are not a healthcare provider. Information on our Sites, including buying guides, blog posts, and educational content about hair loss, cancer treatment, mastectomy, scalp care, and related topics, is provided for general informational purposes only and is not medical advice. It is not a substitute for the advice of your physician or other qualified healthcare professional. Always consult your healthcare provider with questions about your health, treatment, or recovery.

You represent that the content is yours to share and does not violate anyone else's rights.
Acceptable Use

Indemnification

Force Majeure
Headcovers is not responsible for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disasters, severe weather, fire, labor disputes, supply chain disruptions, manufacturer or carrier delays, internet or utility outages, government actions, or pandemics.
Concerns, Disputes, and Chargebacks
If you have a concern about an order, please contact us first so we can make it right. Most issues are resolved quickly and directly.
For items that are eligible for return, refunds are issued only after the item is returned to us and inspected, as described in our Return & Refund Policy. A payment dispute or chargeback is not a substitute for returning an item. You agree that you will not seek a refund for the same order through both a return and a chargeback, and that an item you keep is not eligible for a refund.
We encourage you to contact us before initiating a payment dispute so we can try to resolve the issue directly. Nothing in these Terms limits any rights available to you under applicable law or your card network's rules. We reserve the right to dispute invalid chargebacks, to recover amounts owed to us, including the value of unreturned merchandise and related fees and costs, and to decline future orders from customers who file chargebacks in bad faith or for merchandise they have kept.
You agree to inspect your order promptly upon delivery and to report any error or defect within 3 days of delivery, as described in our Return & Refund Policy.
Governing Law and Dispute Resolution
These Terms, and any dispute or claim arising out of or relating to them, your use of our Sites, or any purchase you make from us, are governed by the laws of the State of Texas, without regard to its conflict of law principles. Subject to the arbitration provision below, you agree that any dispute will be brought and resolved exclusively in the state courts located in Galveston County, Texas, or in the United States District Court with jurisdiction over Galveston County, Texas, and you consent to the personal jurisdiction and venue of those courts.
Binding Arbitration and Class Action Waiver
Please read this section carefully. It affects how disputes between you and Headcovers are resolved.
Informal resolution first. Before starting an arbitration, you agree to contact us at [email protected] and give us at least 30 days to try to resolve the dispute informally.
Agreement to arbitrate. Except as stated below, any dispute or claim arising out of or relating to these Terms, our Sites, or any purchase will be resolved by final and binding individual arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, and judgment on the arbitrator's award may be entered in any court with jurisdiction. This does not apply to chargebacks or to the payment dispute process, which are governed by your card network's rules and applicable law.
Class action waiver. You and Headcovers agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims.
Small claims carve-out. Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies. This preserves your right, and ours, to use small claims court.
Your right to opt out. You may opt out of this arbitration provision by emailing [email protected] with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
This section does not apply where prohibited by law.
Electronic Communications
By using our Sites or communicating with us electronically, you consent to receive communications from us electronically, including notices, disclosures, and agreements. You agree that electronic communications satisfy any legal requirement that such communications be in writing.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the Sites after changes are posted constitutes acceptance of the revised Terms.
Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. These Terms, together with our Privacy Policy, Consumer Health Data Privacy Policy, Shipping & Policies, and Return & Refund Policy, make up the entire agreement between you and Headcovers regarding your use of the Sites.
